comments made by Transport for London (TfL) on their S73 application to vary the planning permission they obtained to replace the existing Waitrose West Ealing supermarket with a new one and to construct 428 BTR residential units (including affordable) above and around it. LB Ealing planning committee members resolved to grant planning permission and the S106 Agreement is close to completion.

At his previous employer, Stephen advised JLP on the application that the S73 application sought to vary. The main issues were car parking for the replacement supermarket and the proposed vehicle access arrangements. TfL maintained throughout that the new supermarket should have zero car parking spaces. Both TfL and highway officers from LB Ealing took the view that the vehicle access arrangements did not afford sufficient priority for pedestrians.

LB Ealing highway officers were ultimately persuaded on supermarket car parking, but neither were satisfied on vehicle access. JLP lodged an appeal for non-determination of the application and Stephen Eyton acted as expert transport witness at the Inquiry. The appeal was allowed and planning permission was granted.
